Rahul Gandhi challenged the 2-year sentence in the Gujarat High Court

Ahmedabad. In the defamation case related to the statement ‘Modi surname by Rahul Gandhi on Tuesday’, the decision of the sessions court has been challenged in the Gujarat High Court. The Surat sessions court had upheld the trial court’s decision of two years’ imprisonment in the defamation case.

A Court of Metropolitan Magistrate in Surat had on March 23 sentenced the Congress leader to two years imprisonment after holding him guilty for his remark during an election rally in 2019 that ‘how can all thieves have Modi surname’.

After this decision of the court, Rahul, who was elected MP from Wayanad, was disqualified from the membership of the Lok Sabha. Rahul made this comment in Kolar in April 2019 during the campaign for the Lok Sabha elections.

Significantly, according to the Representation of the People Act, a person sentenced to imprisonment for two years or more will be disqualified ‘from the date of conviction’ and he will be disqualified to become a public representative for six years after completion of the sentence.
