New Delhi: Supreme Court Chief Justice CJI DY Chandrachud has praised the Central Government. Used to be. DY Chandrachud said, ‘These (three new) laws are historic for our society, because criminal law affects our society day by day. Criminal law dictates the moral compass of the nation and also has the potential to deprive people of their precious liberties. The process of law that governs crimes from the initiation of criminal proceedings by the state to the conviction for the crime ensures that no person is charged or convicted without due process of law. ‘

He said, ‘One aspect of our criminal laws which was most shocking was that they were very old… 1860, 1872 and even 1973. I believe that the passing of these new laws by Parliament is a clear indication that India is changing and new legal approaches are needed to deal with the current challenges. The purpose of our laws is to give victims agency and control in the criminal process, as well as a sense of justice.

Our laws also need to address these concerns by addressing age-old issues such as lack of witnesses, delay in investigation, delay in adjudication of cases, overcrowding in jails and the issue of undertrials.CJI Chandrachud further said, ‘The newly enacted criminal laws have transformed India’s legal framework on criminal justice into a new era. Much-needed reforms have been made to protect the interests of victims and to efficiently conduct investigation and prosecution of crimes.

However, recently the Government of India has approved a budget of Rs 7 thousand crore for the judiciary under the e-Court project. Between November and March 31, we have spent Rs 850 crore to upgrade hardware and software in the courts of the country. In the matter of preparing digital evidence, we should respect and protect the privacy of the accused as well as the victim. We must instill public confidence in protecting the privacy of our citizens and build overall confidence in the criminal justice system.
